Indemnification, Venue, Mediation, and Choice of Law
As a condition of use of this web site, you agree to indemnify Owner and its affiliates and employees from any and all liabilities from your use of this web site.
By accessing and/or using this website, the internet user agrees that any dispute, controversy or claim arising out of or related to this website or its contents shall be exclusively heard and settled by expedited non- binding mediation in New York, New York, administered by a reputable organization engaged in alternative dispute resolution (“ADR Organization”) chosen by Touro in its sole and absolute discretion. The costs of such mediation shall be borne equally by the parties, and each party shall be responsible for their own attorney fees. If upon completion of mediation, all or any part of the dispute remains unresolved, either party may file a complaint in the Supreme Court of the State of New York, County of New York. The time for commencement of such an action shall begin once the mediation process has ended without resolution of the dispute, and specifically, on the date when either party gives written notice to the other that impasse has been reached. The statute(s) of limitations governing the claims asserted in the action shall be tolled pending the mediation through the date of the impasse notice. It is agreed that if a Supreme Court action is to be filed, the laws of New York State shall apply without regard to its conflict of law provisions.
